Kawasaki's Tom Sykes may face losing the third place in Monza's second World Superbike race he got back on appeal after Aprilia lodged a further protest.
The incident will now be heard by the International Disciplinary Court in the near future after the Italian team stumped up £1100 to get Sylvain Guintoli back on to the podium and re-claim vital points.
Aprilia believed that Sykes broke the rules when he ran off track while in second place on the last lap of race two and came back on in front of Guintoli, causing the French rider to slow down. Other riders had been penalised over the weekend for re-joining the track either in an unsafe manner or for gaining a place or time advantage.
The initial protest by Aprilia was upheld at the track giving Guintoli third but an appeal from Kawasaki then reversed the decision but it will now go to a higher power.
