Former 500cc World Champion Kevin Schwantz and his lawsuit against the Circuit of the Americas and its former president Steve Sexton will finally get its first court hearing on February 10 at Austin in Texas.
The American is suing for unspecified damages as the result of 'tortious interference and fraudulent misrepresentations' by COTA and Sexton over the promotion rights to the MotoGP round in Texas.
Schwantz maintains that MotoGP owners Dorna sorted out a deal that gave him an exclusive ten-year deal to promote a race in his home state and that he was negotiating with Sexton and COTA to make it happen at Austin.
He claims that Sexton and COTA then went around the back and struck their own deal which effectively froze him out but also led to Dorna breaching their agreement with him.
